These terms and condition should be read in conjunction with your policy documents.

Definitions
“CCP Cover” means the service provided by Climate Control Protection

“Area” means the area identified on your Certificate based on the original survey and any future amendments notified to and agreed by Us in writing

“You” and “Your” means the customer (e.g. company/organisation) or, as the context requires, any officer of the customer.

“Us” “We” and “CCP” CCP, its staff and agents

“Our Equipment” means the equipment We supply on a temporary basis under the terms of the Policy

“Certificate” means the certificate issued to You following the risk assessment survey

The terms and conditions set out within this booklet explain the current details of the services available to clients with CCP Cover. These services are provided by Climate Control Protection (CCP) (a division of Climate Control Protection Ltd) or any of the subsidiaries of Climate Control Protection Ltd. CCP and its logo are trademarks owned by Climate Control Protection Ltd.

On completion of our risk assessment survey, completion of any necessary works and on receipt of Your premium, You will receive a Certificate detailing your policy number and details of the Area together with identification of heat exit points and electrical supplies. The Certificate must be displayed prominently in the Area to ensure there is no delay in the installation of emergency equipment.

The Terms and Conditions of CCP Cover, as set out in this booklet are correct at time of going to press but may change during the period of relevant cover.

1. The set up fee of CCP costs £50.00 plus VAT for any single legal entity or single partnership. This is a one off fee to provide membership to CCP and benefits with CCP’s associated companies. This fee is to be paid in full up front and is in addition to the annual policy premium.
This fee entitles you to

(a) to a discount upon the hire of equipment from
CCP
(b) to effect a policy for CCP Cover

2.1 Policy Premium Payment Terms and initial works

i) The following terms of payment for policies are required:

a) 100% of premium prior to start of policy cover
or
b) subject to credit approval, 20% of premium prior to start of policy cover, followed by 11 monthly payments thereafter. If any installment is not made within 14 days of the due date, the policy and membership of CCP shall lapse and any monies then paid (including for membership of CCP) will be forfeited

ii) All other works carried out as agreed must be paid for in full prior to the commencement of the policy.

2.2 Failure to meet the terms in 2.1 above will nullify any cover provided by CCP.

3.1 Subject to the Terms and Conditions CCP’s standard policy provides for the loan and installation of temporary climate control equipment for the Area to the required level for a maximum of 4 weeks from the date of claim. If units are required for a longer period full rental charges at the rates then prevailing will apply less Member’s discount.

3.2 A maximum of 3 claims under the policy for each policy year may be made subject to a cumulative total of equipment loan periods pursuant to such claims of 4 weeks. A policy year is 12 months from the later of :

a) commencement
b) renewal of the policy.

4. CCP Cover and its associated service as outlined in paragraph 4.1 and 4.2 below are available (subject to the terms and conditions and payment of the relevant fee) when Your existing climate control systems fails due to breakdown. CCP Cover does not provide cover for routine servicing or non-essential repairs of your equipment. CCP Cover is not to be used and is not available in place of regular servicing and maintenance as recommended by the manufacturer of the original equipment.

4.1 The provision of temporary climate control equipment in the Area in order to maintain desired climatic conditions in the event of main equipment breakdown

4.2 The provision of temporary climate control equipment other than in the Area to the same level as agreed in the original survey should it be necessary to relocate from the Area due to fire, flood or other natural disaster not caused through terrorism (but not the relocation of temporary climate control equipment from the Area to the new area) (Clause 12).

Provided always the level of service available depends on the service level requested at the time of taking out the policy.

5. CCP reserves the right to refuse to provide emergency service unless You are present.

6. Whilst CCP seeks to meet the service needs of all its clients at all times, its resources are finite and this may not always be possible – for example, when CCP is faced with circumstances outside of its reasonable control or expectations such as (but without limitation) extreme weather conditions. Without prejudice to Paragraph 7 below under no circumstances shall CCP be responsible for any indirect, economic or consequential losses which result form any service provided (or failure to provide service), whether caused by negligence or otherwise.

7. CCP’s maximum liability howsoever arising for failure to perform its obligations shall be limited to the return of the relevant annual premium or part then paid by You. CCP reserves the right to refuse service where it is required when the problem with the installed system is substantially the same as a previous problem arising in the Area within the immediate preceding 3 months and which has not been rectified by You. CCP does not accept any responsibility, however caused, for Your equipment failure including data loss. CCP only undertakes to provide temporary cooling to the Area by reasonable means.

8. CCP is not in a position to comment on the general condition of existing equipment or the length of time of repair or cost to repair. However, We may be able to suggest suitable companies for this repair.

9. CCP follows strict Health and Safety Rules and at no time will CCP deviate from the original risk assessment or breach any Health and Safety Regulations.

10.1 If CCP finds that modifications of your systems or the Area have been made without notification in writing to Us or the Heat Exit Points have been blocked or restricted, We will endeavour to provide our service but you must meet any costs associated with removing such blockage or providing additional equipment to meet the new requirement not notified to Us.

10.2 If You change the Area or equipment or situation covered by the policy without notifying Us of these changes any additional cooling required would be charged at the standard rate less member’s discount.

11. In the event of air conditioner failure You must contact Us for assistance promptly. CCP takes no responsibility if a third party is contacted and CCP is under no obligation to reimburse You or the third party.

12. In the event of fire or flood to the Area not caused by war or terrorism before the installation of the temporary climate control equipment CCP will use reasonable endeavours to provide cooling to cover the similar size area as the Area and equipment if it is deemed necessary temporarily to relocate the Area.

13. It is Your responsibility to ensure that the adequate power is supplied to the Area.

14. No claim can be made for two clear days after the policy has commenced and accepted by CCP. If We supply temporary climate control equipment within this period You will incur full hire charges less the CCP member’s discount.

15. Any false claim, however occurring, will result in full hire charge of any units used plus the immediate termination of the policy without refund.

16. If CCP requests service records on the existing climate control equipment. You will promptly supply the same to Us.

17. CCP’s Standard Call Out is within 4 hours from receiving initial claim call but this call out time is only a guide and whilst CCP strives to achieve this, CCP or its agents cannot be held responsible if this time is exceeded for whatever the reason.

18. Commissioning of temporary units will vary in every situation. CCP will endeavour to stabilise the situation in the most reasonable effective manner whilst temporary units are being commissioned.
Should the cooling provided by CCP be insufficient due to extreme weather conditions then CCP will use reasonable endeavours to provide additional units at no extra cost.

19. CCP is unable to provide any guarantees in relation to Your power supply. At the time of initial survey the power requirements will be discussed including the option to separate emergency air conditioning power supply from any sensitive equipment supply.

20. If you call out CCP out of agreed call times this will result in extra charge to the member.

21. Any equipment failures to the temporary climate control equipment must be notified to the claim line immediately. Should We find that failure has not occurred or is due to Your neglect CCP will charge for the relevant call out.

22. Any recommendation and modifications that are highlighted within the policy documentation must be undertaken either by CCP (at Your cost) or Your own contractor within the time agreed, but if the latter CCP reserve the right to check that the works have been carried out satisfactorily.

23. All survey’s will have a plan of Area and equipment/people to be covered and will be signed by Your representative and on behalf of CCP. It will be Your responsibility to make sure that the person signing the agreement will have Your authority to sign. Any modification to this plan must be notified immediately to CCP to ensure continuation of coverage.

24. The “survey” will remain the property of CCP at all times..

25. Cancellation of service

25.1 You may cancel the policy:
i) Within 14 days of start of cover without penalty charge. Any other work carried out will be charged in full excluding membership charge.
ii) 14 days to end of 3rd month, 50% of year’s premium will be charged, plus any other work carried out.
iii) End of 3rd month to end of 6th month 75% of years premium will be charged, plus any other work carried out.
iv) 6 months plus full premium, plus any other work carried out.

25.2 Cancellation after any claim at any time during the policy’s life will result in full payment of premium for the full year and all extra costs incurred by the member.

25.3 CCP reserves the right to cancel at any time, and unless such cancellation is for cause a due proportion of the premium will be refunded at CCP’s discretion.

26. At all times CCP and/or its agents remain the owners of Our Equipment and any losses or damages will be charged to You at list price then prevailing.

27. You are responsible for obtaining additional equipment outlined in the policy such as scaffolding, access equipment or other lifting equipment.

28. You are responsible for insuring the Our Equipment whilst on your premises.

29. At the end of the claim You must terminate the loan of Our Equipment through the claim line and CCP will arrange the decommissioning and removal Our Equipment. This will be done as quickly as possible and not more than 7 days after the termination date. You are responsible for Our Equipment until collection has been completed by Us.

30. You are required to pay for all fuel including electricity and gas relating to Our Equipment.

31. You must not move or interfere with or attempt to repair Our Equipment or allow others to do so.

32. You must not transfer or assign any of your rights or obligations under this agreement.

33. There will be an additional charge if when Our engineers arrive on site there is no representative available from You.

34. Exclusions

Notwithstanding any other provision We shall have no liability or obligation under the policy in respect of:

34.1 Repairs and maintenance to fixed climate control equipment.

34.2 Any costs arising from the Risk Assessment and its associated recommendations.

34.3 Subject to Clause 4.2 loss or damage arising out of fire lightning explosion, flood inundation or water leaking or discharged from any sprinkler installation or any attempt thereof.

34.4 Loss or damage caused by the willful neglect of You or Your equipment.

34.5 Loss or damage occurring by fire or explosion occasioned by or happening through or in consequence directly or indirectly of Terrorism.

34.6 Any consequence whether direct or indirect of war invasion act of foreign enemy hostilities (whether war be declared or not) civil war rebellion revolution insurrection military or usurped power confiscation commandeering nationalisation or requisition or destruction of or damage to property by or under the order of any Government Public Municipal or Local Authority riot strike lockout or civil commotion.

34.7 Loss or damage occasioned by pressure waves caused aircraft and other aerial devices travelling at sonic or supersonic speeds.

34.8 Loss of power to your building however it may be caused.

34.9 The inability to gain safe access to the Area
